Idaho License Recognition License Requirements for Alberta Licensees


LICENSE RECOGNITION AGREEMENT
BETWEEN

THE IDAHO REAL ESTATE COMMISSION
AND
THE REAL ESTATE COUNCIL OF ALBERTA

The following license recognition agreement shall become effective upon the signature and approval of the Real Estate Council of Alberta and the Idaho Real Estate Commission or their designated signatories. This agreement is between the Real Estate Council of Alberta, in the Province of Alberta, Canada (hereinafter referred to as "Alberta") and the Idaho Real Estate Commission, in the State of Idaho, United States (hereinafter referred to as "Idaho").

WHEREAS Alberta and Idaho desire to enter into a license recognition agreement concerning the granting of real estate licenses in his respective jurisdictions, and

WHEREAS Alberta and the Idaho have the legal authority to enter into such a license recognition agreement, such authority being contained in the Statutes of Alberta and Idaho, and

NOW THEREFORE IT IS AGREED THAT LICENSES WILL BE GRANTED UNDER THIS AGREEMENT ON THE FOLLOWING CONDITIONS:

  1. For convenience, the term "Salesperson" is used in this agreement. However, it is agreed that a "Salesperson" in the Idaho statutes is the same and equivalent to a real estate "Agent" or "Associate Broker" in Alberta in the Real Estate Act Rules for licensing purposes and for the purposes of this agreement.

  2. The successful completion of the resident jurisdiction's Salesperson's licensing examination and the granting of a Salesperson's license by the resident jurisdiction, in accordance with resident jurisdiction's statutes, will be recognized by the nonresident jurisdiction's statutes in satisfaction of the Salesperson's licensing requirements of the nonresident jurisdiction's statutes and will enable such person to obtain, upon filing the proper application and fees, a primary Salesperson's license or equivalent from the nonresident jurisdiction.

  3. The successful completion of the resident jurisdiction's Broker's examination and the granting of a real estate employing broker's license by the resident jurisdiction in accordance with the resident jurisdiction's statutes will be recognized by the nonresident jurisdiction in satisfaction of the nonresident jurisdiction's statutes and enable such person to obtain, upon filing the proper application and fees, a primary real estate Broker's license or the equivalent from the nonresident jurisdiction.

  4. It is agreed the application will require candidates for licensure to.

    1. Provide a Certificate of License History certifying the applicant's licensure and good standing in the state (or province) they are currently licensed. Two years of cumulative licensure and active real estate experience, within the last five years, will be required for licensure as a Broker in Alberta or Idaho.

    2. In the case of Alberta licensees, agree to be bound by Idaho Statutes and Real Estate Commission Rules and, in the case of Idaho licensees, agree to be bound by Alberta Statutes and the Rules of the Real Estate Council of Alberta.

    3. Agree to service of process in any civil action.

    4. In the case of Alberta licensees, submit to the jurisdiction of the Idaho Real Estate Commission, and in the case of Idaho licensees, submit to the jurisdiction of the Real Estate Council of Alberta, for purposes of investigation and disciplinary actions.

  5. In the case of a person moving either from Alberta to Idaho, or from Idaho to Alberta, such person shall be able to obtain, upon filing the proper application and other requisite documents together with applicable fees, the equivalent resident license in the new state or province of residence. Application must be made within one year after moving to the appropriate state or province.

  6. All fees assessed by Alberta shall be payable in Canadian dollars. All fees assessed by Idaho shall be payable in U.S. dollars.

  7. The parties to this agreement shall issue, renew and continue a license only where a licensee granted a license under this agreement complies with the continuing education requirements of his state or province of residence.

  8. The licensing authorities of the resident state or province shall, upon request, provide a Certificate of License History certifying the applicant's current licensure and good standing in the applicant's state or province of residence.

  9. The parties to this agreement shall issue, renew and continue licenses provided the licensee agrees to be bound by the statutes and regulations of the nonresident state or province.

  10. The parties to this agreement shall issue, renew and continue licenses provided the licensee by agreement or otherwise is subject to the service of process in any civil action in any form prescribed by the state or province issuing the license.

  11. The parties to this agreement shall issue, renew and continue licenses provided the licensee by agreement or otherwise submits to the jurisdiction of the nonresident state or province for the purposes of investigation and disciplinary action.

  12. Either or both of the above mentioned licensing authorities may refuse to license any applicant for just cause.

  13. The duration of this agreement shall be ongoing until terminated in accordance with the terms herein.

  14. The provisions of this Agreement shall be administered in Idaho by the Idaho Real Estate Commission through its Executive Director and, in Alberta, by the Real Estate Council of Alberta through its Executive Director.

  15. It is anticipated that no real or personal property shall be required for the administration of this agreement.

  16. It is anticipated that all funds necessary to finance the administrative costs of this program in each province or state will be derived from sufficient license fees and appropriate charges made by the licensing authorities in each province or state, and will be borne fully by those persons seeking licensure under this Agreement. There will be no joint funding nor any shared costs of administration between the two licensing authorities.

  17. Pursuant to section 67-2329, Idaho Code, this Agreement must be filed with and approved by the Idaho Secretary of State before it goes into effect. This Agreement shall be in full force and effect upon notification to the parties by the Idaho Secretary of State.

IT IS FURTHER AGREED that this agreement may be terminated at any time, by written notification to the other state or province. Any such termination will occur midnight of the 60th day, or such longer time as specified in the notice, after written notice is received by the other state or province. The notice of termination shall recite, within it, the effective date of the termination.
